Mycogen Seeds reserves the right to substitute product at its discretion in the event of crop or allocation shortages. The Buyer may accept or reject the substitute product at the point of offer. Mycogen Seeds shall not be liable for any breach of warranty or breach of contract claims in connection with unavailable product.

Mycogen Seeds warrants that seed sold by it conforms to the label description on the seed packaging within tolerances established or permitted by law. MYCOGEN SEEDS MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHICH ARE HEREBY DISCLAIMED. It is expressly agreed that Mycogen Seeds’ liability for any loss or damage arising out of or relating to the purchase or use of its products, including but not limited to liability arising out of breach of contract, breach of warranty or negligence, shall be limited, at the sole discretion of seller, to comparable product or to the amount of the purchase price for the seed. This remedy is exclusive. In no event shall Mycogen Seeds be liable for any incidental or consequential damages, including loss of profits.

Mycogen Seeds utilizes isolation and purity measures in the production of its seed products. Because of factors beyond its control, Mycogen Seeds does not represent or warrant that any Mycogen Seeds products are free of any genetically modified materials or organisms.

These terms and conditions of sale are in addition to those contained in Mycogen Seeds sale documents (e.g., order forms) and on Mycogen Seeds product packaging and labeling.


Avicta 500 FS, Avicta Complete Corn 250 and Avicta Complete Corn 500 are Restricted Use Pesticides. For use by certified applicators only. Growers planting Avicta treated seed are not required to be certified applicators.

Avicta technology is protected by U.S. Patent No. 6,875,727.

REVONTEK is an on-seed application, provided by Dow AgroSciences, of separately registered products provided by Syngenta Group Company and Valent U.S.A. Corporation.

REVONTEK is an on-seed application of separately registered products: Cruiser® 5FS, Intego Solo, Maxim® Quattro and Vibrance®.

REVONTEK with Avicta is an on-seed application of separately registered products: Avicta Complete Corn 250 and Cruiser 5FS.

CruiserMaxx Corn 250 is an on-seed application of Cruiser 5FS insecticide delivered at the 0.25 mg a.i./seed rate and Maxim Quattro fungicide.

CruiserMaxx Vibrance Beans is an on-seed application of CruiserMaxx Vibrance alone or with Apron XL.

CruiserMaxx Sunflower is an on-seed application of Cruiser 5FS insecticide and three fungicides: Apron XL, Maxim 4FS and Dynasty.

Seed products with the LibertyLink® (LL) trait are resistant to the herbicide glufosinate ammonium, an alternative to glyphosate in corn, and combine high-yielding genetics with the powerful, non-selective, postemergent weed control of Liberty® herbicide for optimum yield and excellent weed control.

Seeds containing the Roundup Ready® trait and the Roundup Ready 2 Yield® trait are protected under numerous U.S. patents. Seed containing patented traits, such as seed containing the Roundup Ready and Roundup Ready 2 Yield traits, can only be used to plant a single commercial crop and cannot be saved and replanted. Examples of patented seed include Roundup Ready 2 Yield soybeans, Genuity® Roundup Ready spring canola and Genuity Roundup Ready winter canola. Additional information and limitations on these products are provided in the Monsanto Technology Stewardship Agreement and the Monsanto Technology Use Guide. Not only can it be illegal to save and replant patented seed, but as a grower, you need to consider the yield results and profitability. Mycogen Seeds offers no quality guarantee for bin-run seed. Growers also incur extra costs, like cleaning, storage, handling and germination testing, for such endeavors.

ALWAYS READ AND FOLLOW PESTICIDE LABEL DIRECTIONS. Roundup Ready® crops contain genes that confer tolerance to glyphosate herbicides. Glyphosate herbicides will kill crops that are not tolerant to glyphosate.

Cobalt Advanced, Durango DMA, FulTime NXT, Instinct, Keystone LA NXT, Keystone NXT, PropiMax, Resicore, Sonic, SureStart II, Surpass NXT and Surveil are not registered for sale or use in all states. FulTime NXT, Keystone LA NXT, Keystone NXT, Resicore, SureStart II and Surpass NXT are not available for sale, distribution or use in Nassau and Suffolk counties in the state of New York. Contact your state pesticide regulatory agency to determine if a product is registered for sale or use in your state. Do not fall-apply anhydrous ammonia south of Highway 16 in the state of Illinois. State restrictions on the sale and use of Hornet WDG apply. Consult the label before purchase or use for full details.

Enlist Duo herbicide is not registered for sale or use in all states or counties. Contact your state pesticide regulatory agency to determine if a product is registered for sale or use in your area. Enlist herbicides are the only 2,4-D products authorized for use in Enlist crops.
